ISLAMABAD: KP Chief Minister (CM) Ali Amin Gandapur did not appear in the Anti Terrorism Court (ATC) Islamabad Wednesday and his arrest warrants were also not suspended.
According to report sources said ATC had declared Ali Amin Gandapur proclaimed offender in I-9 case. Ali Amin Gandapur was declared proclaimed offender due to non appearance in the court.
Ali Amin Gandapur will appear in ATC led by judge Tahir Abbas.
Trial of Faisal Javed Khan, Wasiq Qayyum and others has been started.
CM KP Ali Amin Gandapur filed petition seeking suspension of his arrest warrants on October 21, 2022. The petition was filed in ATC led by judge Tahir Abbas Sipra.
The counsel said they have resorted to Peshawar High Court (PHC) for relief in all cases. PHC has restrained police from arresting Ali Amin Gandapur in all these cases.
It was prayed in the petition arrest warrants be suspended till the decision of writ petition in Peshawar High Court (PHC).
Judge Tahir Abbas Sipra of ATC took up the petition for hearing. He announced interval till the appearance of Ali Amin Gandapur on the petition seeking suspension of arrest warrants.
Counsel Raja Zahoor ul Hassan said PHC has restrained police from arresting Ali Amin Gandapur till next hearing.
Judge Tahir Abbas Sipra said I am not going to get arrest Ali Amin Gandapur. Go to IG Police and ask him that there is order of court and he cannot be arrested. No information from PHC has been received in this court.
The court remarked Ali Amin Gandapur is proclaimed offender from this court and due to it his non-bailable arrest warrants were issued.
Judge Tahir Abbas Sipra said no new arrest warrant was issued by the court. This court had issued warrants before your resorting to high court. Court had written only for compliance of arrest warrants.
The arrest warrants of Ali Amin Gandapur could not be suspended in the court. Hearing of the case was adjourned till July 10.
The counsel said Ali Amin Gandapur cannot appear today. I will present him on July 10 at every cost.
The judge remarked advertisement in regard to the accused was issued under 87. Advertisement cannot be cancelled unless he appears in the court. Ali Amin Gandapur will have to appear in the court to seek relief. PHC order is in place. How can I issue new order.
