Islamabad High Court Suspends CDA’s Order to Cancel Plot Allotments in Capital Sectors

ISLAMABAD; The Islamabad High Court (IHC) has suspended the Capital Development Authority’s (CDA) decision to cancel the allotment of plots in various sectors of the capital, while issuing notices to the authority and directing it to submit a written response before the next hearing.

Justice Muhammad Azam Khan of the IHC passed the interim order while hearing petitions filed by citizen Umar Rana and other affected buyers. The petitioners maintained that they had lawfully purchased the plots from the original allottees, fulfilling all legal requirements, after which the CDA itself transferred ownership in their names following due process.

Represented by Advocate Adil Aziz Qazi, the petitioners argued that on July 28, 2025, the CDA suddenly issued cancellation orders for the allotments. He contended that the rights of the current buyers could not be undermined by any actions of the original allottees.

He further submitted that the CDA had neither declared the original allotments illegal nor taken any action against the initial allottees, but instead attempted to dispossess the present buyers of valuable properties.

The petitioners stressed that they had purchased the plots transparently and that their legal ownership was being unlawfully jeopardized. The court, after hearing initial arguments, issued notices to all parties and adjourned proceedings until October 6. It directed the CDA to furnish its written reply before the next hearing and also provide a copy of the response to the petitioners’ counsel.

According to sources, in recent weeks the CDA has cancelled allotments of more than 300 plots across different sectors of Islamabad. These plots were originally allotted to affectees nearly a decade ago, many of whom subsequently sold them to various citizens. The current petitioners are among those subsequent buyers now seeking judicial protection of their property rights.
